1. Acceptance of Terms

By accessing or using HigherLMS, LLC's ("HigherLMS") services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

2. Description of Services

HigherLMS provides a learning management system ("Services") that allows users to create, manage, and participate in educational courses. The Services include, but are not limited to: course content, user accounts, and support services.

3. User Accounts

Users must create an account to access certain features of the Services. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

4. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

Use the Services in any way that violates any applicable federal, state, local, or international law or regulation.
Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.
Impersonate or attempt to impersonate HigherLMS, a HigherLMS employee, another user, or any other person or entity.

5. Intellectual Property

The Services and their entire contents, features, and functionality are owned by HigherLMS, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Users are responsible for ensuring that any content they upload to the Services does not violate copyright laws. You agree not to upload, post, or otherwise transmit any content that you do not have the right to upload under any law or under contractual or fiduciary relationships.

Curriculum and Original Content

Any curriculum or original content created by users belongs to its creator. HigherLMS and its employees will not use, share, or distribute this content without the explicit permission of the creator.

6. Termination

HigherLMS reserves the right to terminate or suspend your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

7. Limitation of Liability

In no event will HigherLMS, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services.

8. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Services thereafter.
